The European Commission's recent green paper on damages actions for breach of EC antitrust rules stirred a debate across Europe on the need for legal reform that would encourage private plaintiffs to claim compensation for losses suffered as a result of anticompetitive conduct. Prominent in the wake of that initiative was the international conference convened by the Max Planck Institute for Comparative and International Private Law in Hamburg in April 2006, the papers and proceedings of which are presented in this important book. Among the topics and issues raised and discussed here are the following: the 2001 Courage judgment of the European Court of Justice, in which the court decided that everyone who suffers losses from a violation of arts. 81 or 82 EC is entitled to compensation; relevance of the case law that contributes to general principles of European tort law; comparative analysis from the more comprehensive experience of national laws in the United States, Germany, France, and Italy; calculation of damages; passing-on of losses sustained in an upstream market to customers in a downstream market; procedural devices which may help to overcome the lack of implementation; duties of disclosure and the burden of proof; collective actions that may help to overcome the rational abstention of individuals; pitfalls of leniency programmes implemented by national competition authorities; and, issues of jurisdiction and choice of law. The lively debates that followed the presentations at the conference are also recorded here. Although more discussion will be needed before a viable legal framework in this area begins to emerge, these ground-breaking contributions by lawyers of various disciplines, jurists, economists, academics, and European policymakers take a giant step forward. For lawyers, academics, and officials engaged with this important area of international law, this book clearly improves our understanding of the economic need and legal particularities which could generate an effective European system of private antitrust litigation.

English summary: As a former member of the Deregulation Commission (1988-1991) and a present member of the German Monopolies Commission, Jurgen Basedow has published numerous small papers on economic deregulation, and they have been collected in this volume. They focus on the impact that European Community law has on the regulatory structures of markets such as transport, insurance, legal services etc., on the relationship between deregulation and harmonization and on the role of competition law in deregulated markets. German description: Die Freiheit der wirtschaftlichen Betatigung ist in Deutschland nach wie vor durch eine Vielzahl staatlicher Eingriffe beschrankt. Die Deregulierungsphase zu Anfang der neunziger Jahre hat zwar einige Markte dem Wettbewerb geoffnet, ist aber in vielen Sektoren ohne Wirkung geblieben. Jurgen Basedow, gegenwartig Mitglied der Monopolkommission, hat diesen Prozess von Anfang an begleitet und ihn mit zahlreichen kleineren Schriften gefordert, die vielfach an entlegenen Stellen oder noch gar nicht veroffentlicht sind. Diese Arbeiten werden hier im Kontext publiziert. This book endeavours to interpret the development of private international law in light of social change. Since the end of World War II the socio-economic reality of international relations has been characterised by a progressive move from closed to open societies. The dominant feature of our time is the opening of borders for individuals, goods, services, capital and data. It is reflected in the growing importance of ex ante planning – as compared with ex post adjudication – of cross-border relations between individuals and companies. What has ensued is a shift in the forces that shape international relations from states to private actors. The book focuses on various forms of private ordering for economic and societal relations, and its increasing significance, while also analysing the role of the remaining regulatory powers of the states involved. These changes stand out more distinctly by virtue of the comparative treatment of the law and the long-term perspective employed by the author. The text is a revised and updated version of the lectures given by the author during the 2012 summer courses of the Hague Academy of International Law.
