Il volume offre una panoramica di alcuni temi e problemi del diritto pubblico comparato, coniungando alla trattazione delle tematiche più classiche (metodo della comparazione, forme di governo, giustizia costituzionale), lo studio di alcuni profili problematici, che si impongono sempre più all’attenzione del giurista nell’attuale contesto globalizzato e plurale (il principio di laicità, aborto e wrongful life). Peculiarità del presente volume è la sua articolazione secondo logiche di globalità e di trasversalità, in parziale discrepanza con le classiche trattazioni di diritto pubblico comparato in cui si preferisce procedere illustrando i diversi stati e i relativi ordinamenti secondo una logica di verticalità. Non resta che augurare al lettore un buon viaggio, se è vero, come è vero, che comparare “is somewhat like travelling. The traveller and the comparatist are invited to break away from daily routines, to meet the unespected and, perhaps, to get to know the unknown”. Lorenza Violini è professore ordinario di Diritto costituzionale presso il Dipartimento di Diritto Pubblico Italiano e Sovranazionale dell’Università degli Studi di Milano. Ha compiuto studi e ricerche negli Stati Uniti e in Germania, approfondendo in numerose pubblicazioni temi relativi ai rapporti tra i diversi livelli di governo, al federalismo, al regionalismo e ai diritti fondamentali. É membro del Consiglio direttivo della Rivista Le Regioni. È membro dell’Executive Board della Fundamental Rigths Agency (Vienna).

Is academic freedom threatened? The book examines current challenges to academic freedom in Europe, focusing mainly on Italy and Germany. The cases discussed demonstrate that research and teaching are under pressure in European democracies: in Hungary and Poland due to political constraints, in other countries due to societal expectations. Considering different interrelated aspects, the four parts of the book explore many real and potential threats to universities, scientific institutions and researchers, ranging from the European dimension of freedom of the arts and sciences to comparative analysis of emerging challenges to academic freedom against the backdrop of the COVID-19 pandemic. They highlight threats to university autonomy from the economic orientation of university governance, which emphasizes efficiency, competition, and external evaluation, and from new rules concerning trigger warnings, speech restrictions, and ethics commissions. Detailed study of these complex threats is intended to stimulate scholarly reflection and elicit serious discussion at European and national level. The volume contributes to the search for a new role of universities and scientific institutions and is addressed to academics and political stakeholders.
